We now are considering a divorce, which we can still file in the United States. How can my spouse maintain her Golden Visa if we divorce? Do we have to invest another €500.000 in her name to preserve her Golden Visa? Our divorce is amicable, and we can craft the US divorce decree to state whatever is necessary for purposes of any visa issues in Spain.

Hi Peter, Spain Golden Visa Program started in 2013, so any investment before that cannot be qualified for a Golden Visa.

Hi Alen, with the Spain Golden Visa you can live and work in Spain and travel visa-free in the EU-zone. So, it wouldn\’t stand for a residency permit for the Netherlands.

I heard that I can stay in the Netherlands for 3 months without any residence permit. Does my golden visa somehow works as residence permit from the Netherlands too ?

I think yes. But you may need to hurry because I heard that if it has been more than 5 years since you buy the property, you will not be able to apply for the program.

I may not be able to stay in Spain for 7 days in the first year. I think this may be a problem for my second year application. Actually, I don\’t want to postpone the application until a year later. Do you think I can somehow deal with not visiting Spain in the first year?

Hi Rawy, Spain has a double taxation treaty with most of the countries, which means you do not have to pay taxes in both countries. However, taxation should be discussed based on your specific case. Are you planning to move into Spain permanently, or to spend a part of the year in the country?

Considering that I bought the property and start to live in Spain. Do I have to pay taxes both in Spain and my own country or does the program have any sanction to allow me not to pay both?

Hello, thank you for your inquiry. It is true that EU residents and citizens are not allowed to apply for the Spain Golden Visa program.
The basis for being turned down could be due to the fact that (1) you already have residency in an EU-member state, Denmark, or (2) assuming that your EU citizen spouse that was part of your application.
If it is the latter, perhaps not including your spouse in your application may be a way to get around the issue. Having said that this is not a legal opinion.
Please feel free to get in touch with us through info@getgoldenvisa.com and we would gladly refer you to a legal representative from our team that may have a more professional response for you.

I hold the temporary residency in Denmark. I’ve just solely acquired >500k property in Spain and applied for a golden visa. Unfortunately my application is turned down on the grounds that I am married to EU citizen. How reasonable is this and where to look for that article explaining the refusal. Thank you!

Sky is the limit after you prove investment maintenance my friend. Besides you should prove that economical dependance of your children on you in each renewal. The residence visa will be renewed initially for 2year term. The residence authorization will be renewed initially for a 5year.

I had the same issue. Fortunately you can do it. A mistress from Getgolden Visa told me that there would be no problem if the property bought after 2014.

I had the same question in my mind a week ago. Its simple actually. You can travel freely but you can’t register as a resident in belgium. You can’t stay in another country for more than 3 months with this. To live there you will probably have to get another visa.
